Terms and Conditions for PickUP Namibia

Welcome to PickUP Namibia, a ride-sharing platform that connects drivers with passengers for convenient and affordable inter-town travel in Namibia. By using our app and services, you agree to comply with these Terms and Conditions (“Terms”). Please read them carefully.

If you do not agree with any part of these Terms, you must stop using PickUP Namibia immediately.

1. Acceptance of Terms

By accessing or using the PickUP Namibia app, website, or services, you confirm that:

• You are at least 18 years old and legally capable of entering into agreements.
• You agree to be bound by these Terms, our Privacy Policy, and any additional policies.
• You will comply with all applicable Namibian laws and regulations.

2. User Accounts

A. Registration

• You must provide accurate and complete information when signing up.
• You are responsible for maintaining the security of your account (e.g., password protection).
• False information may result in account suspension or termination.

B. Account Termination

• PickUP Namibia reserves the right to suspend or terminate accounts for violations of these Terms.
• Users may delete their accounts at any time via app settings.

3. Ride-Sharing Services

A. For Passengers

• You agree to pay the fare as displayed before booking.
• Cancellation fees may apply if you cancel after a driver accepts your request.
• You must treat drivers and co-passengers with respect; any harassment or misconduct may lead to a ban.

B. For Drivers

• You must have a valid driver’s license, vehicle insurance, and roadworthy car.
• You set your own prices and routes, but PickUP Namibia may suggest competitive rates.
• You are not an employee of PickUP Namibia—you operate as an independent service provider.
• Discrimination or refusal of service without valid reason is prohibited.

C. Ride Conduct

• No smoking, alcohol, or illegal substances are allowed during rides.
• Seatbelts must be worn at all times.
• PickUP Namibia is not liable for any disputes between drivers and passengers.

4. Payments & Fees

• Passengers can pay via cash or digital payment (as supported by the app).
• Drivers receive earnings after deductions (if any), subject to withdrawal processing times.
• PickUP Namibia may charge a service fee per transaction.
• Refunds (if applicable) will be processed as per our Refund Policy.

5. Safety & Responsibility

• Drivers must ensure their vehicles are safe and roadworthy.
• Passengers should verify driver/vehicle details before boarding.
• PickUP Namibia conducts background checks, but users must exercise caution.
• We are not liable for accidents, injuries, or damages occurring during rides.

6. Prohibited Activities

You must not:
❌ Use the app for illegal activities (e.g., transporting drugs, weapons).
❌ Harass, discriminate, or harm other users.
❌ Impersonate another person or use fake accounts.
❌ Manipulate fares or engage in fraudulent transactions.
❌ Reverse-engineer or hack the app.

Violations may result in legal action and permanent bans.

7. Intellectual Property

• The PickUP Namibia app, logo, and content are owned by us.
• You may not copy, modify, or redistribute any part without permission.

8. Limitation of Liability

• PickUP Namibia acts as a platform—we do not employ drivers or own vehicles.
• We do not guarantee uninterrupted service or app availability.
• We are not responsible for:
  • User conduct (drivers/passengers).
  • Delays, accidents, or disputes.
  • Third-party services (e.g., payment processors).

9. Changes to Terms

We may update these Terms periodically. Continued use of the app means you accept the changes.

10. Governing Law & Disputes

• These Terms are governed by Namibian law.
• Any disputes shall be resolved through negotiation or mediation before legal action.
